El próximo 3 de junio, la Oficina Española de Patentes y Marcas (OEPM) junto con la Cátedra ClarkeModet-UPM, presentan el informe conjunto sobre el “first filing” en la Ley de Patentes Española, en vigor desde el 1 de abril de 2017.
El objetivo de este informe es dar claridad sobre una de las consultas más recurrentes sobre la Ley de Patentes Española: La obligación que se establece sobre las invenciones realizadas en España de llevar a cabo la primera solicitud de patente ante la OEPM.
- Si el solicitante tiene su domicilio, sede social o residencia habitual en España, ¿se presume que la invención se realizó en territorio español?
- ¿La residencia de los inventores afecta a esta presunción?
- ¿Qué consecuencias acarrea la falta de cumplimiento de esta obligación?
- ¿Cómo se recomienda actuar?
